financial abuse of elderly texas: Elder Abuse and Its Prevention National Research Council, Institute of Medicine, Board on Global Health, Forum on Global Violence Prevention, 2014-03-18 Elder Abuse and Its Prevention is the summary of a workshop convened in April 2013 by the Institute of Medicine's Forum on Global Violence Prevention. Using an ecological framework, this workshop explored the burden of elder abuse around the world, focusing on its impacts on individuals, families, communities, and societies. Additionally, the workshop addressed occurrences and co-occurrences of different types of abuse, including physical, sexual, emotional, and financial, as well as neglect. The ultimate objective was to illuminate promising global and multisectoral evidence-based approaches to the prevention of elder maltreatment. While the workshop covered scope and prevalence and unique characteristics of abuse, the intention was to move beyond what is known about elder abuse to foster discussions about how to improve prevention, intervention, and mitigation of the victims' needs, particularly through collaborative efforts. The workshop discussions included innovative intervention models and opportunities for prevention across sectors and settings. Violence and related forms of abuse against elders is a global public health and human rights problem with far-reaching consequences, resulting in increased death, disability, and exploitation with collateral effects on well-being. Data suggest that at least 10 percent of elders in the United States are victims of elder maltreatment every year. In low- and middle-income countries, where the burden of violence is the greatest, the figure is likely even higher. In addition, elders experiencing risk factors such as diminishing cognitive function, caregiver dependence, and social isolation are more vulnerable to maltreatment and underreporting. As the world population of adults aged 65 and older continues to grow, the implications of elder maltreatment for health care, social welfare, justice, and financial systems are great. However, despite the magnitude of global elder maltreatment, it has been an underappreciated public health problem. Elder Abuse and Its Prevention discusses the prevalence and characteristics of elder abuse around the world, risk factors for abuse and potential adverse health outcomes, and contextually specific factors, such as culture and the role of the community. |

financial abuse of elderly texas: Elder Mistreatment National Research Council, Division of Behavioral and Social Sciences and Education, Committee on Law and Justice, Committee on National Statistics, Panel to Review Risk and Prevalence of Elder Abuse and Neglect, 2003-02-06 Since the late 1970s when Congressman Claude Pepper held widely publicized hearings on the mistreatment of the elderly, policy makers and practitioners have sought ways to protect older Americans from physical, psychological, and financial abuse. Yet, during the last 20 years fewer than 50 articles have addressed the shameful problem that abusersâ€and sometimes the abused themselvesâ€want to conceal. Elder Mistreatment in an Aging America takes a giant step toward broadening our understanding of the mistreatment of the elderly and recommends specific research and funding strategies that can be used to deepen it. The book includes a discussion of the conceptual, methodological, and logistical issues needed to create a solid research base as well as the ethical concerns that must be considered when working with older subjects. It also looks at problems in determination of a report's reliability and the role of physicians, EMTs, and others who are among the first to recognize situations of mistreatment. Elder Mistreatment in an Aging America will be of interest to anyone concerned about the elderly and ways to intervene when abuse is suspected, including family members, caregivers, and advocates for the elderly. It will also be of interest to researchers, research sponsors, and policy makers who need to know how to advance our knowledge of this problem. |

financial abuse of elderly texas: Medical Malpractice Litigation Bernard S. Black, David A. Hyman, Myungho Paik, William M. Sage, Charles Silver, 2021-04-27 Drawing on an unusually rich trove of data, the authors have refuted more politically convenient myths in one book than most academics do in a lifetime. —Nicholas Bagley, professor of law, University of Michigan Law School Synthesizing decades of their own and others’ research on medical liability, the authors unravel what we know and don’t know about our medical malpractice system, why neither patients nor doctors are being rightly served, and what economics can teach us about the path forward. —Anupam B. Jena, Harvard Medical School Over the past 50 years, the United States experienced three major medical malpractice crises, each marked by dramatic increases in the cost of malpractice liability insurance. These crises fostered a vigorous politicized debate about the causes of the premium spikes, and the impact on access to care and defensive medicine. State legislatures responded to the premium spikes by enacting damages caps on non-economic, punitive, or total damages and Congress has periodically debated the merits of a federal cap on damages. However, the intense political debate has been marked by a shortage of evidence, as well as misstatements and overclaiming. The public is confused about answers to some basic questions. What caused the premium spikes? What effect did tort reform actually have? Did tort reform reduce frivolous litigation? Did tort reform actually improve access to health care or reduce defensive medicine? Both sides in the debate have strong opinions about these matters, but their positions are mostly talking points or are based on anecdotes. Medical Malpractice Litigation provides factual answers to these and other questions about the performance of the med mal system. The authors, all experts in the field and from across the political spectrum, provide an accessible, fact-based response to the questions ordinary Americans and policymakers have about the performance of the med mal litigation system. |

financial abuse of elderly texas: Cult of Glory Doug J. Swanson, 2021-06-08 “Swanson has done a crucial public service by exposing the barbarous side of the Rangers.” —The New York Times Book Review A twenty-first century reckoning with the legendary Texas Rangers that does justice to their heroic moments while also documenting atrocities, brutality, oppression, and corruption The Texas Rangers came to life in 1823, when Texas was still part of Mexico. Nearly 200 years later, the Rangers are still going--one of the most famous of all law enforcement agencies. In Cult of Glory, Doug J. Swanson has written a sweeping account of the Rangers that chronicles their epic, daring escapades while showing how the white and propertied power structures of Texas used them as enforcers, protectors and officially sanctioned killers. Cult of Glory begins with the Rangers' emergence as conquerors of the wild and violent Texas frontier. They fought the fierce Comanches, chased outlaws, and served in the U.S. Army during the Mexican War. As Texas developed, the Rangers were called upon to catch rustlers, tame oil boomtowns, and patrol the perilous Texas-Mexico border. In the 1930s they began their transformation into a professionally trained police force. Countless movies, television shows, and pulp novels have celebrated the Rangers as Wild West supermen. In many cases, they deserve their plaudits. But often the truth has been obliterated. Swanson demonstrates how the Rangers and their supporters have operated a propaganda machine that turned agency disasters and misdeeds into fables of triumph, transformed murderous rampages--including the killing of scores of Mexican civilians--into valorous feats, and elevated scoundrels to sainthood. Cult of Glory sets the record straight. Beginning with the Texas Indian wars, Cult of Glory embraces the great, majestic arc of Lone Star history. It tells of border battles, range disputes, gunslingers, massacres, slavery, political intrigue, race riots, labor strife, and the dangerous lure of celebrity. And it reveals how legends of the American West--the real and the false--are truly made. |

financial abuse of elderly texas: Communities in Action National Academies of Sciences, Engineering, and Medicine, Health and Medicine Division, Board on Population Health and Public Health Practice, Committee on Community-Based Solutions to Promote Health Equity in the United States, 2017-04-27 In the United States, some populations suffer from far greater disparities in health than others. Those disparities are caused not only by fundamental differences in health status across segments of the population, but also because of inequities in factors that impact health status, so-called determinants of health. Only part of an individual's health status depends on his or her behavior and choice; community-wide problems like poverty, unemployment, poor education, inadequate housing, poor public transportation, interpersonal violence, and decaying neighborhoods also contribute to health inequities, as well as the historic and ongoing interplay of structures, policies, and norms that shape lives. When these factors are not optimal in a community, it does not mean they are intractable: such inequities can be mitigated by social policies that can shape health in powerful ways. Communities in Action: Pathways to Health Equity seeks to delineate the causes of and the solutions to health inequities in the United States. This report focuses on what communities can do to promote health equity, what actions are needed by the many and varied stakeholders that are part of communities or support them, as well as the root causes and structural barriers that need to be overcome. |

financial abuse of elderly texas: Males With Eating Disorders Arnold E. Andersen, 2014-06-17 First published in 1990. The subject of anorexia nervosa and, more recently, bulimia nervosa in males has been a source of interest and controversy in the fields of psychiatry and medicine for more than 300 years. These disorders, sometimes called eating disorders, raise basic questions concerning the nature of abnormalities of the motivated behaviors: Are they subsets of more widely recognized illnesses such as mood disorders? Are they understandable by reference to underlying abnormalities of biochemistry or brain function? In what ways are they similar to and in what ways do they differ from anorexia nervosa and bulimia nervosa in females? This book will be of interest to a wide variety of people—physicians, psychologists, nurses, social workers, occupational therapists, nutritionists, educators, and all others who may be interested for personal or professional reasons. |

financial abuse of elderly texas: Elder Law Lawrence A. Frolik, Alison McChrystal Barnes, 2015 Elder Law: Cases and Materials, Sixth Edition, is thoroughly updated for use by veteran professors and newcomers in the field. It covers the government programs Medicare, Medicaid, and Social Security, employer pensions, age discrimination, health and long term care quality, housing options, guardianship and alternatives, elder abuse and financial exploitation, and health care decision making. As in past editions, ethical issues relating to mental capacity and family representation are introduced, then explored in subsequent chapters. Through expanded explanations, students are encouraged to grasp the frameworks of such complex programs as Medicare and Medicaid. Questions and hypothetical problems, with answers provided to the teacher, will stimulate student discussion of underlying elder law policies and strategies of practice. These provide regular opportunities to assess student comprehension. New material beginning in the first chapter recognizes the implications of greater longevity among those who are approaching old age, and how their lifestyles differ from 20th century expectations. Always of note, the chapter Paying for Long Term Care, presents the federal rules governing eligibility and limitations of Medicaid coverage for the cost of nursing home care, the heart of Medicaid planning. The chapter also describes desirable alternatives to Medicaid long term care, based on making an elder's assets last a lifetime. The chapter Health Care Decision making describes evolving attitudes and law on physician assisted dying, given the growing number of states providing this option to citizens. This book also is available in a three-hole punched, alternative loose-leaf version printed on 8.5 x 11 inch paper with wider margins and with the same pagination as the hardbound book. |

financial abuse of elderly texas: Project Renewment Bernice Bratter, Helen Dennis, 2013-11-02 For the first time in history, career women -- women who have worked outside the home for most of their lives -- are retiring. Without role models, they look to one another to face the changes this life transition brings. Career women from the Baby Boom and pre-Baby Boom, or Silent, generations are approaching retirement. They want to know what it means to suddenly find themselves back inside their homes after having devoted their lives to careers outside of them. These women are highly skilled, educated and successful. They have achieved visibility, status and influence. And because they are the first large group of American women to define themselves by their work, they have few, if any, models for retirement. Project Renewment will show women that giving up their careers does not mean giving up who they are. Renewment is a term the authors created as an alternative to the word retirement, which they associated with negative stereotypes and clichés. A combination of retirement and renewal, Renewment suggests optimism and opportunity, growth and self-discovery. Project Renewment is a grassroots movement among women who are close to retirement or recently retired and looking to connect with one another. The women of Project Renewment believe that retiring is a process of change and increasing self-awareness. As they redirect the commitment and passion previously dedicated to their careers, they transform and reshape their lives. Project Renewment provides these women with an enriched and safe environment in which to explore and confront the challenges that lie ahead as they leave behind a lifetime at the office, hospital, studio or courtroom. Diverse topics are discussed, such as Who am I without my business card? What if he retires first? What is productivity anyway? Why do I feel guilty reading a book on a Tuesday afternoon? How do I feel about not earning another dollar? Divided into two sections, Project Renewment offers insight and support in a friendly, humorous and meaningful way. The first part of the book addresses the challenges that career women tackle when looking to retire. The second teaches readers how to start and maintain their own Project Renewment group, so they can find support, inspiring relationships and even a few laughs as they look to get the most out of the rest of their lives. |
