financial transactions and reports analysis centre of canada: Italy International Monetary Fund. Legal Dept., 2016-02-10 This report provides a summary of the anti-money laundering and combating the financing of terrorism (AML/CFT) measures in place in Italy as at the date of the onsite visit. It analyzes the level of compliance with the Financial Action Task Force recommendations and the level of effectiveness of Italy's AML/CFT system, and provides recommendations on how the system could be strengthened. Italy has a mature and sophisticated AML/CFT regime, with a correspondingly well-developed legal and institutional framework. Law enforcement agencies access, use, and develop good quality financial intelligence. Financial sector supervisors have been using a risk-based approach to varying degrees, but their supervisory tools could be improved. |
financial transactions and reports analysis centre of canada: Financial Intelligence Units International Monetary Fund, 2004-06-17 Over the past decade and beyond, the need for a modern anti-money-laundering strategy has become widely accepted internationally. Depriving criminal elements of the proceeds of their crimes has increasingly been seen as an important tool to combat drug trafficking and, more recently, as a critical element in fighting organized crime, corruption, and the financing of terrorism, and maintaining the integrity of financial markets. The first few financial intelligence units (FIUs) were established in the early 1990s in response to the need for countries to have a central agency to receive, analyze, and disseminate financial information to combat money laundering. Over the ensuing period, the number of FIUs has continued to increase, reaching 84 in 2003. This handbook responds to the need for information on FIUs. It provides references to the appropriate Financial ActionTask Force (FATF) standards wherever appropriate. |

financial transactions and reports analysis centre of canada: Money Laundering in Canada Margaret E. Beare, 2007-06-09 Money laundering is the process of converting or transferring cash or other assets, generated from illegal activity, in order to conceal or disguise their origins. In recent years, the international community has decided that focusing on money laundering is an efficient strategy in policing organized crime and, now terrorism. To this end, countries are encouraged to harmonize their policies and legislation and, to some extent, their policing strategies. Before adopting these new strategies, however, it is important to understand the extent of money laundering in different jurisdictions, as well as the likelihood of success and the costs involved in these anti-laundering strategies. This new work by Margaret E. Beare and Stephen Schneider brings empirical evidence to the study of money laundering in Canada - a topic that has recently assumed an international profile. They challenge the seemingly common sense notion, fueled by political posturing and policing rhetoric, that taking the profits away from criminals is a rational law enforcment strategy. Using data from police cases, the inner working of financial institutions, and the 'successful' claims of privilege from our legal profession, the final picture that the authors paint is of a good enforcement strategy run amuch amid conflicting interests and agendas, an overly ambitious set of expectations, and an ambiguous body of evidence as to the strategy's overall merits. |

financial transactions and reports analysis centre of canada: Money Laundering and Illicit Financial Flows John a Cassara, 2020-05-15 Outside of crimes of passion, criminals, criminal organizations, kleptocrats, and some businesses and corporations are motivated by greed. In today's increasingly interconnected world, the criminal manifestations of unchecked avarice impact all of us - politically, socially, economically, and culturally. Transnational crime effects our individual and collective security. The magnitude of crime is measured in the multi-trillions of dollars annually. Laundering or hiding and disguising the proceeds of crime is essential for criminal organizations. Unfortunately, the last thirty years have demonstrated that our anti-money laundering (AML) countermeasures are not effective. Examining the metrics that matter, we are a decimal point away from total failure. The outlook going forward is not promising. Money Laundering and Illicit Financial Flows - Following the Money and Value Trails is the first book to take a hard look at our AML track record. Written primarily from a law enforcement perspective, the book examines old and new money laundering methodologies. It exposes threats, enablers, and facilitators. Making the case for an AML paradigm shift, the book offers alternative steps forward. Combining facts, straight-forward explanations, case studies, as well as the author's personal experiences, views and commentary, this book is valuable to the public and private sectors, policy makers, as well as students and concerned citizens. As a former Treasury Special Agent, John Cassara has investigated and studied money laundering for over 30 years. Equally at home in back streets or government bureaucracies, he has a unique perspective and offers an insider's knowledge. He delights in telling it as it is. The author of five books and countless articles on money laundering and threat finance, Cassara continues to surface important issues that deserve our attention. |
financial transactions and reports analysis centre of canada: Money Laundering John Madinger, 2011-12-14 Many changes have occurred in the twenty-five years that have passed since the enactment of the Money Laundering Control Act of 1986. The law has been amended, new underlying crimes have been added, and court decisions have modified its scope. The Act remains an important tool in combating criminal activity. Now in its third edition, Money Laundering: A Guide for Criminal Investigators covers the basics of finding ill-gotten gains, linking them to the criminal, and seizing them. Providing a clear understanding of money laundering practices, it explains the investigative and legislative processes that are essential in detecting and circumventing this illegal and dangerous activity. Highlights of the Third Edition include Important court decisions and changes in federal law since the Second Edition New trends in crime and terrorism financing The rise of money laundering in connecting with major frauds, including the Bernie Madoff case Law and policy shifts related to terrorism and financing since the Obama administration New methods for financial intelligence and the filing of Suspicious Activity Reports How changes in technology have enabled launderers to move funds more easily and anonymously Knowledge of the techniques used to investigate these cases and a full understanding of the laws and regulations that serve as the government’s weapons in this fight are essential for the criminal investigator. This volume arms those tasked with finding and tracing illegal proceeds with this critical knowledge, enabling them to thwart illegal profiteering by finding the paper trail. |
financial transactions and reports analysis centre of canada: Politically Exposed Persons Theodore S. Greenberg, Larissa Gray, Delphine Schantz, Carolin Gardner, Michael Latham, 2010-04-19 In recent years, revelations of grand corruption and the plunder of state assets have led to greater scrutiny of financial relationships with politically exposed persons (PEPs) senior government officials and their family members and close associates. Notwithstanding the efforts by many financial institutions and regulatory authorities to prevent corrupt PEPs from entering and using the financial system to launder the proceeds of corruption, there has been an overall failure in the effective implementation of international standards on PEPs. Implementation of an effective PEP regime is a critical component in the prevention and detection of transfers of proceeds of crime and, therefore, ultimately in the process of recovering them. 'Politically Exposed Persons: Preventive Measures for the Banking Sector' is designed to help banks and regulatory authorities address the risks posed by PEPs and prevent corrupt PEPs from using domestic and international financial systems to launder the proceeds of corruption. The book provides recommendations and good practices aimed at improving compliance with international standards and increasing supervisory effectiveness. It is an important tool for individuals, governments, financial and private sector companies, and international organizations involved in developing and implementing standards aimed at fighting corruption and money laundering, and trying to recover stolen assets and the proceeds of corruption. |
financial transactions and reports analysis centre of canada: Preventing Money Laundering and Terrorist Financing , 2009 Money laundering and terrorist financing are serious crimes that affect not only those persons directly involved, but the economy as a whole. According to international standards, every bank has the obligation to know its customers and to report suspicious transactions. Although these obligations sound straightforward, they have proved challenging to implement. What information precisely has to be gathered? How should it be recorded? If and when does one have to file a suspicious transaction report? It is here that a supervisor can play a crucial role in helping supervised institutions; first, in understanding the full extent of the obligations of Customer Due Diligence and Suspicious Transaction Reports (STR) and, second, in ensuring that those obligations are not just words on paper but are applied in practice. Effective supervision is key to the success of a country's AML/CFT system. In this regard, field work in both developed and developing countries has shown an overall low compliance in the area of supervision of banks and other financial institutions; supervisory compliance is indeed generally lower than the average level of compliance with all Financial Action Task Force recommendations. As a result, by providing examples of good practices, this book aims to help countries better conform to international standards. In this regard, this handbook is specifically designed for bank supervisors. |

Then, in one fateful night, she lost everything, and the nightmare began Jennifer Robertson was working hard to build a life for herself from the ashes of her first marriage. Still only twenty-six, she swiped right on a dating app and met Gerry Cotten, a man she would not normally have considered—too young and not her type—but found she’d met her match. Eccentric but funny and kind, Cotten turned out to be a bitcoin wizard who quickly amassed substantial wealth through his company, Quadriga. The couple travelled the world, first class all the way, while Cotten worked on his multitude of encrypted laptops. Then, while the couple was on their honeymoon in India, opening an orphanage in their name, Gerry fell ill and died in a matter of hours. Jennifer was consumed by grief and guilt, but that was only the beginning. It turned out that Gerry owed $250 million to Quadriga customers, and all the passwords to his encrypted virtual vaults, hidden on his many laptops, had died with him. Jennifer was left with more than one hundred thousand investors looking for their money, and questions, suspicions and accusations spiralling dangerously out of control. The Quadriga scandal touched off major investment and criminal investigations, not to mention Internet rumours circulating on dark message boards, including claims that Gerry had faked his own death and that his wife was the real mastermind behind a sophisticated sting operation. While Jennifer waited for a dead man’s switch e-mail that would probably never come, it became clear that Cotten had gambled away about $100 million of the funds entrusted to him for investment in his many schemes, leaving Robertson holding the bag. Bitcoin Widow is Catch Me If You Can meets a widow betrayed, a life of fairy-tale romance and private jets torched by duplicity, as Jennifer Robertson tries to reset her life in the wake of one of the biggest investment scandals of the digital age. |

financial transactions and reports analysis centre of canada: Dirty Money Christian Leuprecht, Jamie Ferrill, 2023-09-15 Financial crime in Canada remains a mystery: omnipresent, but we know little about its operation. Transactions are cloaked with apparent legality, which makes tracking criminal activity through economic or financial statistics a complex undertaking. This distinctive volume aims to stem in-, out-, and through-flows of vast sums of dirty money by enhancing Canada’s capacity to detect, disrupt, deter, investigate, and prosecute domestic financial criminals and transnational organized criminal organizations. It brings together leading scholars and practitioners from the public and private sectors to identify and explore deficiencies in federal and provincial policy, regulation, legislation, politics, institutions, and enforcement, as well as the international financial crime regime. Together contributors pinpoint weaknesses that have turned the Canadian federation into a destination of choice for global financial crime, where its perpetrators can operate with impunity. Dirty Money reveals how globalization and technology have spun an extensive web of clandestine processes that disguises how financial criminals operate, the channels they use, and how they suborn banks and institutions. In the process, the extent of financial crime in Canada and its corrosive effects on communities, democratic institutions, and prosperity becomes apparent. Cockfield, Caroline Dugas, Jamie Ferrill, Cameron Field, Michelle Gallant, Peter German, Rhianna Hamilton, Todd Hataley, Caitlyn Jenkins, Christian Leuprecht, David Maimon, Katarzyna (Kasia) Mcnaughton, Denis Meunier, Pierre-Luc Pomerleau, Stephen Schneider, Jeffrey Simser. |
financial transactions and reports analysis centre of canada: The 9/11 Effect Kent Roach, 2011-08-15 This book critically and comparatively examines the responses of the United Nations and a range of countries to the terror attacks on September 11, 2001. It assesses the convergence between the responses of Western democracies including the United States, the United Kingdom, Australia and Canada with countries with more experience with terrorism including Egypt, Syria, Israel, Singapore and Indonesia. A number of common themes - the use of criminal law and immigration law, the regulation of speech associated with terrorism, the review of the state's whole of government counter-terrorism activities, and the development of national security policies - are discussed. The book provides a critical take on how the United Nations promoted terrorism financing laws and listing processes and the regulation of speech associated with terrorism but failed to agree on a definition of terrorism or the importance of respecting human rights while combating terrorism. |
financial transactions and reports analysis centre of canada: The Canada-Vietnam Remittance Corridor Raúl Hernández-Coss, 2005-01-01 Examining the experience of the Canada-Vietnam remittances corridor over the past several years, this title is a first step towards identifying the main features and pointing out some of the areas and issues that researchers and authorities should examine more closely. In contrast to the large size and advanced level of development of the U.S.-Mexico remittances corridor, examined in the first case study, the Canada-Vietnam corridor is small in absolute terms and still at a nascent stage of shifting from informal to formal systems. For purposes of discussion, 'The Canada-Vietnam Remittance Corridor' breaks down the remittance process into three stages: the First Mile, when decisions are in the hands of the remittance sender; the Intermediary Stage, comprising the systems that facilitate the cross-border transfer of funds, and; the Last Mile, where the funds reach the hands of the remittance recipient. By analyzing the objectives, obstacles, incentives, and changes occurring at each of these stages in the Canada-Vietnam corridor, lessons are drawn for other remittance sending and receiving countries that seek to encourage formalization of the flows. |

financial transactions and reports analysis centre of canada: International Anti-Money Laundering and Soft Law Emmanuel Ebikake, 2023-11-20 Adopting a mixed-methods approach, this book assesses the role of soft law as a technique to repress and prevent money laundering. The consequence of the combination of a non-traditional subject matter with the limitations of traditional international law instruments has meant that lawmakers seeking international solutions to the problems of money laundering have had to innovate. This book addresses two fundamental issues in the context of existing international and domestic responses to the problem of money laundering that have hitherto been neglected. These include the nature of the treaty obligations to criminalise money laundering, and the role of soft law as a technique to regulate it globally. The book concludes that international legal harmonisation and approximation of domestic anti-money laundering law through soft law remains helpful in addressing this pressing problem. The book will be of interest to academics, researchers, and policy-makers working in the areas of Financial Crime, Anti-Money Laundering Law, Regulation, International Soft Law, and Comparative Law. |

financial transactions and reports analysis centre of canada: Money Laundering and Terrorism Financing in Global Financial Systems Rafay, Abdul, 2021-04-16 During the last few decades, corrupt financial practices were increasingly being monitored in many countries around the globe. The past few decades have been eventful for these issues. Today, tackling money laundering and terrorism financing are considered key issues in developed and developing countries alike. Eradication of money laundering and terrorism financing through a holistic approach of awareness, prevention, and enforcement is a current need. It has enabled the birth of new regulatory regimes based on strict compliance, robust processes, and technology. One of the many problems with this is the lack of general awareness about all these issues among various stakeholders including researchers and practitioners. Money Laundering and Terrorism Financing in Global Financial Systems deepens the discourse about money laundering, terrorism financing, and risk management in a modern-day environment. It provides a fascinating and invaluable guide for understanding the theory, practice, and cases of these topics. Split into two sections, the first being money laundering and terrorism financing and the second being financial governance and risk management, the chapters create comprehensive knowledge on these acts of crime in the financial industry by defining the crimes themselves, the many challenges and impacts, and potential solutions. This book is ideal for government officials, financial professionals, policymakers, academicians, business professionals, managers, IT specialists, researchers, and students. |

financial transactions and reports analysis centre of canada: Sustainable Consumption Alberto do Amaral Junior, Lucila de Almeida, Luciane Klein Vieira, 2019-10-21 This book provides a broad understanding of whether law plays a role in influencing patterns of sustainable consumption and, if so, how. Bringing together legal scholars from the Global South and the Global North, it examines these questions in the context of national, transnational and international law, within single and plural legal systems, and across a range of sector-specific issue areas. The chapters identify how traditional legal disciplines (e.g. constitutional law, consumer law, public procurement, international public law), sector-related regulation (e.g. energy, water, waste), and legal rules in specific areas (e.g. eco-labelling and packing) engage with the concept of sustainable consumption. A number of the contributions describe this relationship by isolating a national legal system, while others approach it from the vantage point of legal pluralism, exploring the conflicts and convergences of rules between multiple international treaties (or guidelines) and those between the rules of international and transnational law (or both) vis-à-vis national legal systems. While sustainable consumption is recognised as an important field of interdisciplinary research linking virtually all social science disciplines, legal scholarship, in contrast, has neglected the importance of the field of sustainable consumption to the law. This book fills the gap. |

financial transactions and reports analysis centre of canada: Surveillance After September 11 David Lyon, 2003-09-26 Prominent among the quests for post-9/11 security are developments in surveillance, especially at national borders. These developments are not new, but many of them have been extended and intensified. The result? More and more people and populations are counted as suspicious and, at the same time, surveillance techniques become increasingly opaque and secretive. Lyon argues that in the aftermath of 9/11 there have been qualitative changes in the security climate: diverse databases containing personal information are being integrated; biometric identifiers, such as iris scans, are becoming more popular; consumer data are merged with those obtained for policing and intelligence, both nationally and across borders. This all contributes to the creation of ever-widening webs of surveillance. But these systems also sort people into categories for differential treatment, the most obvious case being that of racial profiling. This book assesses the consequences of these trends. Lyon argues that while extraordinary legal measures and high-tech systems are being adopted, promises made on their behalf - that terrorism can be prevented - are hard to justify. Furthermore, intensifying surveillance will have social consequences whose effects could be far-reaching: the undermining of social trust and of democratic participation. |
financial transactions and reports analysis centre of canada: Terrorism and the Law Clive Walker, 2011-03-03 Terrorism law and legal practice has been politically and socially controversial to a degree beyond almost any other legal issue during the past few years, and this analytical text contains extensive analysis of these controversies. Terrorism and the Law offers a thoughtful and up-to-date discussion of all the key materials on terrorism law. It provides comprehensive coverage of all the major domestic, European, and international laws, and their impact on the UK. It also contains an extensive examination of the implementation of these terrorism laws, and of the practical issues they raise. The book contains three Parts. Part I focuses on meanings of 'terrorism' in law and political science. It provides the reader with an understanding of the phenomenon and the legal concept, including its statutory definitions, which is essential to the book's assessment of the strategies and tactics adopted in the codes of laws. It also covers normative constraints, such as human rights. Part II focuses on the United Kingdom law. It provides extensive coverage of the major UK terrorism legislation, such as: the Terrorism Act 2000; the Anti-Terrorism, Crime and Security Act 2001; the Prevention of Terrorism Act 2005; the Terrorism Act 2006; the Terrorism (Northern Ireland) Act 2006; the Justice and Security (Northern Ireland) Act 2007; and the Counter-Terrorism Act 2008. It also examines the key laws and rules relating to terrorism policing and legal processes. It discusses the meaning of these legislative materials, as well as their implementation, and includes reference to case law and practice statements from the police and courts. Part III reflects the impact of European, international and transnational laws and practices, covering international transnational cooperation and extradition, key European Union law measures against terrorism, other international law measures against terrorist activities, and international human rights and terrorism. |
financial transactions and reports analysis centre of canada: Deconstructing Money Laundering Risk Noémi També Bearpark, 2022-07-14 This book examines the interpretation of the risk-based approach (RBA) and its application across the banking industry. It explores the ways conflicting risk interpretation and deconstruction of money laundering risk have unintended consequences across the banking industry. Furthermore, it offers a theoretical framework that can be adopted and implemented by risk practitioners to address money laundering (ML) risks. The interpretation and application of the RBA influences the way money laundering risk is perceived, presented, and managed, often resulting in misalignment among stakeholders. Moreover, AML practitioners interpret money laundering (ML) risk as an entity that can be contained, largely in ignorance of the fact that ML risk is self-referential. The book therefore addresses complex inter-system feedback phenomena that lead to de-risking and re-risking, and offers a new ML risk communication framework on this basis. It will be of value to researchers and also to stakeholders within financial institutions, financial intelligence units and regulators in the fight against money laundering. |

financial transactions and reports analysis centre of canada: Cryptocurrency and Public Policy Donavon Johnson, 2022-11-04 Proponents of cryptocurrency have argued it has the potential to drive economic prosperity and to help reimagine social benefits in many spaces across the world. However, as the knowledge and use of cryptocurrency increases, so do questions about trust, identity, privacy, and security. This new book connects the literature on public policy and cryptocurrency, asking: What are the governance and democracy implications of the rise in cryptocurrency use? Beginning with a conceptual overview of cryptocurrency and how governmental actions (or inaction) led to its creation, author Donovan Johnson argues that symbiotic relationships can and do exist among cryptocurrency, democracy, and governance in the public policy/administration domain. Principles such as equity and inclusion, efficiency and effectiveness, accountability, and quality of life are explored as conduits through which cryptocurrency interfaces with public policy, democracy, and good governance. This informative and insightful book covers a range of public policy and public administration issues, offering readers an understanding of how cryptocurrency intersects with democracy, governance, fiscal and monetary policies, economic growth, corruption, and privacy. Cryptocurrency and Public Policy will be of interest to students and scholars of public policy and administration, finance, economics, and business. |

financial transactions and reports analysis centre of canada: Canada International Monetary Fund. Monetary and Capital Markets Department, 2019-06-24 This Financial System Stability Assessment paper discusses that Canada has enjoyed favorable macroeconomic outcomes over the past decades, and its vibrant financial system continues to grow robustly. However, macrofinancial vulnerabilities—notably, elevated household debt and housing market imbalances—remain substantial, posing financial stability concerns. Various parts of the financial system are directly exposed to the housing market and/or linked through housing finance. The financial system would be able to manage severe macrofinancial shocks. Major deposit-taking institutions would remain resilient, but mortgage insurers would need additional capital in a severe adverse scenario. Housing finance is broadly resilient, notwithstanding some weaknesses in the small non-prime mortgage lending segment. Although banks’ overall capital buffers are adequate, additional required capital for mortgage exposures, along with measures to increase risk-based differentiation in mortgage pricing, would be desirable. This would help ensure adequate through-the cycle buffers, improve mortgage risk-pricing, and limit procyclical effects induced by housing market corrections. |
